Hang Up And Drive: No Cellphone Driving States
We’ve all seen it, in fact a lot of us probably still do it. While not illegal in all states, driving while talking on a cellphone is dangerous and in the end the auto insurance companies get stuck paying the tab for an unsafe driver.
I’ve compiled a list of “no cell phone driving states” or states in which you must use a hands-free headset to talk on the phone while driving. As a side note I’d also like to point out that not enough has been done about texting while driving, but expect most states to have a ban on that as well in the near future.
Below is a list of states that do not allow driving while talking on the cell phone and states with lesser cell phone restrictions.
No Cell Phone Driving States
These are the states that prohibit the talking on a cell phone while driving without using a hands free or headset device.

- New Jersey
- New York
- Washington State (also banned text messaging while driving effective July 2008)
- Washington DC
No Cell Phone Driving Cities/Localities
This is the state by state law that doesn’t necessarily prohibit driving while talking on a cell phone throughout the entire state, instead giving each locality or city the right to enforce the no cell phone driving law.
